COMPREHENSIVE IMMIGRATION REFORM JOKE #4: Exemptions, waivers, discretion.

The Senate’s pending immigration bill includes roughly 400 exemptions, exceptions, waivers, determinations and grants of discretion.The bill’s complexity is forcing opponents and supporters to comb through its 844 pages before they can declare their conditional support or opposition to the high-stakes measure. -MORE HERE

“WAIVER.—The Secretary, in the Secretary’s sole and unreviewable discretion, may waive the application of subparagraph (A) on behalf of an alien,” says one passage on page 71 of the complex document.

The bill mentions “exempt” or “exemption” 18 times.

Except” appears 156 times in the document.

There are 94 uses of “waiver,” including a provision on page 198 that allows the secretary to invite a deported illegal immigrant to return and file for the amnesty.

“The Secretary of Homeland Security may permit an alien to remain temporarily in the United States and authorize the alien to engage in employment in the United States if the Secretary determines that the alien … has been helpful, is being helpful, or is likely to be helpful, in the investigation, prosecution of, or pursuit of civil remedies related to the claim arising from a covered violation.”

“Unreviewable” appears seven times in the bill.

On page 568, for example, the bill declares that “the Attorney General may, in the Attorney General’s sole and unreviewable discretion, appoint or provide counsel to aliens in immigration proceedings conducted under section 240 of this Act.”

ANNUALS OF HOMELAND STUPIDITY: KNIVES ON PLANES

In the bizzaro Obama Administraion way the TSA (aka The Stupid Agency) is now going to allow some knives back on planes. Head of Clownland Security Janet Napolitano needs to be called on the carpet about this and other stupid acts of the agencies under her direction. Including the Federally sponsored jailbreak by ICE releasing thousands (not hundreds like the Obama Administration claimed) of illegal immigrant criminals back into U.S. neighborhoods. LATINOS BEHAVING BADLY!: Sequester Molester?

It's been over a week since some unknown low level ICE bureaucrats staged a Federally sponsored jail break of thousands of illegal immigrants they had already being held in detention because of the sequester cutbacks in Washington. Did ICE deport them. No! They stupidly released them into communities all over the U.S.. They Obama White house has no clue who did this. Even Janet No(enforcement)politano the Head of Homeland Stupidity has no clue who did this. No information has been released on these illegal immigrants on why they were being held in the first place. But, we do know it was for crimes than just being in the U.S. illegally. Over in Springfield Virginia Fairfax County Police say they have a suspected Latino serial fondler on the loose.  A police sketch is shown on the left. There were eight incidents last fall and suddenly there were more this week. Perhaps it is just a coincidence that the new uptick in molestation seems to coincidence with the wanton release of illegal immigrants in Federal Government already in custody . But, I think not.

THE DEPARTMENT OF HOMELAND STUPIDITY

Why anyone would think the Federal Government under Obama could ever secure our borders and live up to ANY comprehensive immigration reform plan is painfully obvious with the release of thousands of illegal immigrants by Immigration and Customs Enforcement. The Federal Government sponsored jail break releasing thousands of criminal illegal immigrants into communities around the United States is not only stupid but, borders on insanity.
Let me get this straight. The Federal Government had these illegal immigrants in custody not only for being in the U.S. illegally but, also for other crimes committed in the U.S. But, instead of deporting them NOW and reducing the expense to the Federal Government in case of a sequester. Some idiot manager at ICE releases them back into U.S. communities.  Oh yeah but, they claim they are being monitored. Uh huh at government expense . Why not just deport them NOW and not release them back into the communities where they committed their crimes. It's just a nutty policy that makes no sense!
What needs to happen is who decided to this. Even before the dreaded sequester excuse happened. Though it certainly fits into the Obama Administration's Failure is an Option plan when it comes to enforcing illegal immigration laws. No doubt head of Clownland Security Janet No(enforcement)politano should be dragged into the investigation. Her henchman at ICE Joe Morton too! Meanwhile, the Obama White house is pulling a Sargent Schultz "We know nothing". Which is why Arizona Governor Jan Brewer rightly remarked "Who is running this country? Who indeed!

JANET NAPOLITANO IS NO LUDITE SHE'S JUST COVERING HER ASS!

It's becoming more clear that the Obama Administration may be one of the most disingenuous and  corrupt administrations of the modern era. From the Fast and Furious fiasco and subsequent collusion with the liberal media outlets at Eric Holder's Department of Justice to Solyndra where a half billion dollars of taxpayer money went down the drain. Now comes the revelation that Janet Napolitano head of Homeland Security does not use e-mail. Tim Cavanaugh at Reason magazine is spot on with this quote:

"It's Cute That Janet Napolitano Avoids Email So Nobody Can Catch Her Breaking the Law" 

Cavanaugh goes on:

"When asked for an explanation for that perverse habit, Napolitano said, "For a whole host of reasons."

* While working as deputy White House chief of staff, President Obama's current campaign manager, Jim Messina, used his AOL account to orchestrate the controversial deal by which drug companies lobbied for and ran ads supporting passage of Obamacare, which was just one example in a government-wide trend.

* Political appointees at another federal agency who found a clever way to not only use private email accounts but to rig the system automatically to remove all traces of them from government servers.

* The U.S. Environmental Protection Agency created secret email accounts that few there knew about and no one apparently can now access, according to an internal document, thus calling into question EPA's compliance with certain laws and lawsuits.

It's pretty clear the Obama Administration talked about transparency but the reality is they are more interested in doing things behind closed doors and  hiding things. In the case of Janet Napolitano it appears she's making sure there is no email trail for her to be questioned on:

Looks like she and others in the Obama administration are making sure they are able to cover their tracks and are able to say "I don't recall" once they are brought before congressional investigators.

You've got to wonder why an Obama Administration appointee working in Homeland Security would tweet “Happy May Day! #solidarity.”  But, Nate Snyder, the special adviser to Homeland Security Secretary Janet Napolitano for “Community Partnership and Strategic Engagement did just that on Monday.   And the Democrats wonder why so many people consider Obama a socialist after he puts people like Synder with his leanings into departments like Homeland Security. Of course he also appointed others like Van Jones into other positions in his administration so there is a pattern here.

ANOTHER OBAMANATION ON IMMIGRATION ENFORCEMENT

I was shocked to learn that our Department of Homeland Security is releasing illegal aliens who have committed crimes back into our communities. It seems instead when a country refuses to take back one of it's citizens slated for deportation by DHS Homeland security is supposed to notify the State Department and sanctions against that country are supposed to be enforced. The Daily Caller has the money quote:

"Homeland Security Secretary Janet Napolitano told a House committee that she is “not aware” of any actions the Obama administration has taken against countries that will not accept back illegal immigrants in “deportation status,” some of whom have committed crimes. After a “six-month detention period,” the illegal immigrants are released within the United States."


Once again when it comes to enforcing the laws of the United States regarding illegal immigration the Obama Administration is making failure a policy choice.

Meanwhile illegal immigrants who have committed crimes are being released back into communities because of this failure!

OBAMA AND THE DEMOCRATS GIVE ILLEGAL IMMIGRANTS A FREE PASS!

Well, President Obama is off to the vacation to the enclave of the wealthy on Martha's Vineyard. how nice. But, those illegal immigrants hanging out in neighborhoods all over the United States:

Well, they are not going anywhere now that the Obama Administration is going to put  deportations of illegal immigrants in the case closed file. Hola sucker Americans!    Here is the money quote on how this plan from the Obama Administration works:

"The idea is set those cases aside... see where we can identify very low priorities, and essentially, administratively, close the case so they no longer clog the system," a senior administration official told reporters.

This is just another example of the "FAILURE IS AN OPTION" plans of President Obama and the Democrats in Congress.Think about that Americans.  The Federal Government has people who they have identified as having broken our immigration laws but, they are giving them a free pass and closing their cases just because they have not broken any laws. But, they have! They have broken our Federal immigration laws! 

 

Yes when it comes to enforcing Federal immigration laws Obama has a plan and it is:

Things are now getting serious with the attempted Christmas Day bombing Abdul Farouk Abdulmutallab. Even more disturbing is the idiotic statement from Obama's Homeland Security Sectratary Janet Napolitano who declared that the system worked in the failed bombing incident. No Ms. Stupido Napolitano the system did not work because this guy got on the plane. The reason why you think the system worked is because the terrorist have not produced a reliable detonator! Janet (no enforcement) Napolitano is now an official member of Obama's Clown Cabinet.

This is not the first time our Clownland Secretary Napolitano has tried to proclaim failure as really success. There was the time when: "Napolitano went on CNN’s “State of the Union” and proclaimed that crossing the border illegally is not a crime. This statement left a lot of folks scratching their heads given that U.S. law—the law Napolitano is sworn to uphold—says quite the opposite. Section 8, Title 1325 of the U.S. code clearly states that those who enter the U.S. illegally are committing a crime."

It may be too much to ask officials of the Obama administration to actually read and understand the laws they are supposed to enforce. Then again maybe it just a normal part of the policy in the Obama Administration where:

Immigration Officials Arrest 300 in California. Yawn!

From today's New York Times:

"LOS ANGELES — Nearly 300 illegal immigrants who had committed serious crimes were deported or detained this week by federal agents in a demonstration of what immigration officials pledged was a new resolve to zero in on the most egregious lawbreakers."

New resolve? How about a "new resolve" to zero in ALL the illegals in our country! You can start with the most "egregious" lawbreakers first but, don't stop there. They have all broken the law!

"John Morton, an assistant secretary in the Department of Homeland Security who is in charge of Immigration and Customs Enforcement, said Friday that focusing on serious criminals helped improve public safety."

If Homeland Security had been doing it's job in keeping these illegal immigrants out of the country in the first place there would be no public safety issue! The Federal Government does not deserve any gold stars for that failure! It just needs to clean up the mess that it created and that does not mean sweeping the illegal immigrant problem under the rug with an amnesty aka "path to citizenship" either! That approach did not work in 1986 and it won't work today!

“These are not people who we want walking our streets,” Mr. Morton said at a news conference here, a day after Homeland Security Secretary Janet Napolitano made much the same point at a Congressional hearing."

I got news for you John that you can pass along to your boss Janet Napolitano at Homeland Security and President Obama. The American people don't want ANY of these illegal immigrants walking and/or loitering around our streets!

Obama's plan for illegal immigration enforcement: Failure!

Speaking about dumb Obama administration officials. Homeland Security Janet (no enforcement) Napolitano also took out the trash on Friday with the following news

"The Obama administration expects Congress to begin moving to overhaul the nation's immigration laws early next year, Homeland Security Secretary Janet Napolitano said Friday, adding that improved border security and a drop in migration caused by the economic downturn make such changes "far more attainable" than in 2007." -Washington Post

Let's see where to began with Secretary Stupido of Homeland Security. I wonder where she gets these crazy ideas. Perhaps from her friend:
The Democratic former Governor of New York Elliot Spitzer who before he resigned in disgrace was calling for drivers licenses for illegals and other bright ideas that reward illegals. Secretary Stupido goes on:

"We will never have fully effective law enforcement or national security as long as so many millions remain in the shadows," Napolitano said.

Does this look like the illegals are "remaining in the shadows" Ms. Napolitano? Seems to me if I am able to find them loitering out in the open in my community than is it asking too much for my Federal Government to find and deport them? Oh, I forgot it's the Obama administration we are talking about here and when it comes to enforcing U.S. laws regarding illegal immigration:

Arizona rollover tragedy. Who is to blame?

Today was the day that there was supposed to be a meeting at the White House of the Obama administration and the groups like La Raza & Democratic Congressman Luis Gutierrez that want amnesty for the 12 million plus illegal immigrants in our country who blatantly choose to ignore our immigration laws. That meeting has been postponed until June 17th. mark that date on your calenders. But this morning CBS radio carried a news story of a rollover of a van in Arizona that was carrying AT LEAST 27 illegal immigrants. Eight were killed and 14 were air lifted to hospitals. Yes, this was a tragedy it's a tragedy for the illegals but the cold hard truth is nobody put a gun to their head and made them enter the U.S. illegally so my sympathy is limited for them. They obviously did not get the memo as Mickey Kaus points out that the illegals are returning home is record numbers. It is also a tragedy for the U.S. taxpayers who will be picking up the the medical costs for those illegals. Here is the money quote:

"We're looking at a lot of expenses tied in with this particular collision and unfortunately the worst part of it is, it's a loss of human life, the unnecessary loss of human lives, and the people who are obviously hurt and seriously injured,"says Santa Cruz County Sheriff Tony Estrada.

Meanwhile U.S. citizens are going bankrupt trying to pay their OWN medical bills. Whose is to blame for this tragedy? Clearly the illegals themselves bare part of of it. The people who were transporting them too. But, I think that most of the blame belongs to our Federal Government. Now run by the Obama administration who continue to allow these illegals to cross our borders and have have an almost criminal lack of enforcement policy once they arrive here. Thanks in part to the liberal Democrats and especially to Homeland Security Secretary Janet NO(enforcement)politano. Bottom line is this accident and other similar incidents would not be happening if the Obama Administration and the Federal Government were doing it's job in border security and enforcing immigration law.

POGO IS ALIVE AND WELL AT HOMELAND SECURITY

One would think this Federal government report from the Department of Homeland Security (with nameless authors) would be an April Fools joke. But, it is not. It is frightening attempt by some people in the government to try and make many American's anger at the failure of the Federal Government on certain issues like illegal immigration be painted as part of some vast "radical" right wing conspiracy. Instead of what it is. The true outrage and anger of U.S. citizens about the continuing failures of the Federal Government. It would be amusing if it was not so frightening that this "official" government report could be used as a pretext for the Obama administration to spy, wire tap and otherwise invade the privacy of U.S. citizens who truly have issues with the way the Federal Government has failed them. There are no names of organizations in the report that the government considers a "right wing extremist" so that means it could be anyone. This whole document smells as if it was written in the offices of the Southern Poverty Law Center. Michelle Malkin has some of the insightful money quotes on this chilling document:

"I have covered DHS for many years and am quite familiar with past assessments they and the FBI have done on animal rights terrorists and environmental terrorists. But those past reports have always been very specific in identifying the exact groups, causes, and targets of domestic terrorism, i.e., the ALF, ELF, and Stop Huntingdon wackos who have engaged in physical harassment, arson, vandalism, and worse against pharmaceutical companies, farms, labs, and university researchers. By contrast, the piece of crap report issued on April 7 is a sweeping indictment of conservatives. And the intent is clear. As the two spokespeople I talked with on the phone today made clear: They both pinpointed the recent “economic downturn” and the “general state of the economy” for stoking “rightwing extremism.” One of the spokespeople said he was told that the report has been in the works for a year. Then there is this useless piece of crap analysis from the nameless DHS report writers:

"Threats from white supremacist and violent anti government groups during 2009 have been largely rhetorical and have not indicated plans to carry out violent acts."

TRANSLATION: These "unnamed" groups are practicing free speech. What a dangerous concept in a democracy! Obviously, the Obama administration and the Department of Homeland Security think so.

Every U.S. citizen should read this DHS report and think very strongly what the implications are for our country, democracy and free speech. Don't forget to smile at the cameras at the TEA PARTY our government will no doubt be watching!

OBAMANATION: No "E" in DHS enforcement!

From the Washington Post:
"Homeland Security Secretary Janet Napolitano has delayed a series of proposed immigration raids and other enforcement actions at U.S. workplaces in recent weeks, asking agents in her department to apply more scrutiny to the selection and investigation of targets as well as the timing of raids, federal officials said."

In other words slow down and cutback on enforcement. Now why would Homeland Security Secretary Napolitano try to delay and cutback on enforcement of our nation's laws?

"The raids have enraged Latino community and religious leaders, immigrant advocates and civil liberties groups important to the Democratic base, who have stepped up pressure on Obama to stop them."

Wuups there it is! So it's not really about enforcing U.S. laws and doing what's right for the country it's about doing what right for the Democratic Party. I wish the Obama administration would come to it's senses and understand that enforcement is not the problem when it comes to illegal immigration. It's the lack of enforcement that is the cause of the problem! Or as Leigh H. Winchell, the ICE special agent in charge in Seattle, wrote in an e-mail to his staff :

"You did nothing wrong and you did everything right," "I cannot control the politics that take place with these types of situations, but I can remind you that you are great servants of this country and this agency."

Mr. Leigh is spot on about the dedicated ICE agents. I wish I could say the same about Homeland Security Secretary Janet Napolitano and the Obama Administration.

Obama picks Napolitano for Homeland Security

Janet Napolitano has been mentioned to head Homeland Security. I am cautiously optimistic about her appointment. She comes from a border state that has more than it's share of illegal immigration problems . So She knows the issue first hand . She was one of the first Governors to declare a state of emergency and put National Guard troops on the border. She was a Federal prosecutor so she respects the law and will make sure they are enforced. Of course she may not be up to speed on the security needs of our coastal ports being from land locked Arizona. But, overall I think it is a good pick for this important office. I guess the only thing now is to complete the vetting process and see who she hangs around with:

Silent Amnesty? How about some yelling voters!

You can certainly see who is taking orders from the gang of 12 Senators and our dumb ass President who are trying to railroad the Senate Amnesty bill for illegal immigrants. Of course there is the surrender monkey Michael Chertoff our "Homeland Security" Secretary. Who all of a sudden decides that he can no longer enforce laws inside the United States. He stated that if the Senate Amnesty Bill does not pass it will in effect be creating a "SILENT AMNESTY" for illegals.
Then there is Arizona Governor Janet Napolitano who is also drinking the Kennedy/McCain/Bush Amnesty kool aid talking points. She has also used the "Silent Amnesty" phrase talking points in talking about her support for the Amnesty Bill.

If the Senate Amnesty Bill is not passed (and hopefully it won't) there will only be a "silent amnesty" if the Federal Government continues to fail to enforce our current immigration laws. You might be surprised what happens when people do their jobs and laws are enforced. Maybe just as surprised as the Senators who vote for the Senate Amnesty bill should be when they are voted out of office.
